James Colwell

James is a specialist in both public family law and private children law and is regularly instructed in complex family proceedings across all stages.

In public law, James represents Local Authorities, parents, extended family members and children via their Children’s Guardian. He has experience in cases involving non-accidental injury, interfamilial sexual abuse, parental mental health, substance misuse, domestic abuse and unlawful removal from the jurisdiction of England and Wales.

James is increasingly instructed in High Court proceedings and proceedings necessitating the instruction of leading and junior counsel, allowing him to expand his practice and gain further experience in high-level complex cases.

In private law, James handles multifaceted residence and contact disputes, including cases involving parental alienation and cases where the instruction of court-appointed experts or FPR 2010 Rule 16.4 Guardians is required. He has represented both applicants and respondents in multi-day Finding of Fact hearings involving allegations of sexual assault, domestic abuse, and physical harm to children, as well as matters with international or cultural elements.

Known for his meticulous preparation, persuasive advocacy, and practical approach, James combines determination with empathy to achieve the best outcomes for his clients.

Re (a child: care proceedings) [2026] – Instructed as junior counsel, alongside Helen Gamble led by Taryn Lee KC acting for a parent in complex proceedings involving multiple medical experts, with significant police and forensic material.

Re (a child: care proceedings) [2025] – Instructed in a complex 18-day public law final hearing in which allegations of significant harm were pursued by the local authority against his client. James undertook cross-examination of multiple witnesses as part of the final hearing. Following extensive evidence and cross-examination, the court did not find there was a risk of sexual harm arising from the actions of James’ client. James was led for the 18-day final hearing following undertaking a significant portion of the case management as sole counsel.

Re (a child: care proceedings) [2025] – Represented a family member in care proceedings at a multi-day finding of fact where allegations of significant harm were pursued by the local authority to identify the perpetrator of inflicted injuries. James successfully cross-examined the medical expert and wider family members leading to the court making no adverse findings against his client.

AB v Durham County Council (Revocation of Placement Orders) [2024] EWFC 370 – James acted for the children by their children’s guardian before Mr Justice Poole in an application by the father for revoke a placement order. Following a three-day contested hearing, the application was refused (a recommendation supported by the guardian).
