Elisha Marsay secures a suspended sentence for two offences of fraud by false representation totalling £58,793.00.
Elisha represented the defendant at Teesside Crown Court following guilty pleas to both offences.
The defendant de-frauded his victim after promising the money would be invested in property but instead, he used it for his own benefit. At the sentencing hearing the Crown made submissions as to the categorisation of harm based on the financial loss and detrimental impact on the victim and placed the offending in category A2.
Following Elisha’s mitigation, the Judge categorised the offending, by a narrow margin, as A3 on the sentencing guidelines which significantly reduced the starting point. The mitigating factors were also considered to outweigh the aggravating factors.
The Judge imposed a 2-year custodial sentence suspended for a period of 2 years with a community order attached which included 200 hours unpaid work, 30 rehabilitation activity requirement days and a 6 months mental health treatment requirement.
